1. Scope of Application
These Terms and Conditions apply to all orders of Dobrao via our online shop to private consumers (“Customers”). By placing an order, the Customer agrees to these terms.
2. Product Description
Our Dobrao are high-quality mouthpieces made from brass, bronze, or stainless steel, designed for playing the Berimbau. Each item is sold individually. Customization options such as laser engraving are available; please contact us for details.
3. Contract Formation
Product descriptions on our website are non-binding and serve as an invitation to make an offer. The Customer submits an order by completing the checkout process. We confirm receipt of the order immediately by email. The purchase contract is only concluded when we send a shipment confirmation or deliver the Dobrao.
4. Prices and Payment
All prices include applicable VAT and other taxes unless otherwise specified. Payment can be made via bank transfer, PayPal, or other available methods chosen by the Customer. Payment must be completed prior to shipment.
5. Delivery and Shipping
We will ship the ordered Dobrao promptly after payment confirmation. Delivery times depend on the shipping method and destination. We are not responsible for delays caused by third parties or force majeure.
6. Right of Withdrawal
Consumers have a 14-day right of withdrawal from the purchase without providing any reason. The withdrawal period is 14 days from receipt of the product. To exercise this right, the Customer must notify us in writing within this period.
7. Returns and Refunds
Returns are accepted only if the product is defective or does not match the description provided. Customized products may have specific return conditions; please contact us beforehand.
8. Warranty and Liability
The Dobrao are sold as new (depending on stock). We warrant that they are free from material defects at delivery unless otherwise agreed upon. Liability is limited to replacement or repair unless otherwise required by law.
9. Data Protection
Your personal data will be processed in accordance with our Privacy Policy.
10. Jurisdiction and Applicable Law
For all disputes arising from this contract, Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Braunau am Inn, Austria.
11. Alternative Dispute Resolution Act – Online Stores
The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
